As of 2026, an admission system will enter into force regarding the provision of labour in the Netherlands. The law on admission to the posting of workers (in Dutch: Wtta) introduces stricter regulation of staffing agencies and other lenders to better protect the position of workers and tackle malpractices in the staffing sector. The law thus aims to create a safer and fairer labour market for both workers and bona fide companies. The Wtta replaces the current Waadi registration obligation.

The admission system (4 pillars)

  1. Admission mechanism:
  • Prohibition on lending staff without admission.
  • Conditions for admission:
    • KvK-registration
    • Financial security: â‚Ĵ 100 k deposit for existing, â‚Ĵ 50 k for start-ups
    • VOG for companies
    • Compliance with framework of standards, report required (based on current NEN-4400)
  1. Periodic checks:
  • Annual inspections (audits) by private inspection bodies to ensure compliance with framework of standards
  1. Administrative supervison:
  • The Dutch labour inspectorate supervises the admission system and related obligations. The labour inspectorate can impose administrative sanctions.
  1. Liabilty Hirers:
  • Hirers may only hire labour from authorised lenders. Violation leads to sanctions.

Scope of the admission system

The authorisation requirement applies to all
lenders, including employment agencies, payrollers, and foreign lenders.

Exceptions to the lending ban:
Contracting, peer lending, labour pools, job placement, interns, self-employed workers (excluding false self-employed), and certain sectoral exceptions fall outside the scope of the admission system

Lender’s duty of administration, notification and information

Lenders must keep records of which workers they make available and at which hirers.

Lenders have a reporting obligation that must be fulfilled before the start of the posting.

Lenders have an obligation to pass on equal treatment information to workers.

The prohibition on hiring

Hirers may only hire labour from authorised lenders. There is a monitoring obligation on hirers to ensure that both the formal employer (pass-through lender) and the lender are authorised.

Hirer’s administration obligation

Hirers must keep records of which workers are provided to them by which lenders, and keep these records for seven years.

Timeframe

The Wtta will enter into force from 1 January 2026. Enforcement will presumably take place from 1 January 2027.

Transitional rule: if you filed an application for admission before 1 July 2025, you can continue doing business permissibly from 1 January 2026, even if the application is still pending.

As an alternative to a compliance report on compliance with the new framework of standards, you can use existing NEN-4400 certification!

Admission will be issued for four years.
